Corrales Growers’ Market By-Laws 2004

Vision Statement
The Corrales Growers’ Markets were founded in support of the cultural and economic traditions of the community. The desire to maintain and continue those traditions is at the heart of efforts to see the Markets’ continued success. The Corrales Growers’ Markets operate to provide a location for marketing and education opportunities that bring people who grow food and people who buy that food face to face.

Article I - Purpose

Section 1. The purpose of the Market is:
1. To support small farms and family agricultural businesses by providing marketing opportunities and support.
2. To provide education about farmers’ markets and promote community support of local agriculture.
3. To promote the use of the markets by local growers and farms.
4. To promote the use of the markets by consumers as a source of fresh, nutritional agricultural products.

Section 2. Growers are encouraged to use organic methods of growing so that the market will also provide a source of organically grown produce for our customers.

Article II

Name, Location and Time
Section 1. The name of the organization shall be Corrales Growers’ Markets, hereafter know as the Markets.

Section 2. The location of the Markets will be the Corrales Community Recreation Center, at 500 Jones Road.

Section 3. The Sunday market will operate from 9:00am to 12:00 pm. The Wednesday market will operate from 4:00pm to 7:00pm.

Section 4. The starting date for the Sunday Market will be the last Sunday in April. The Sunday Market will end the last weekend in October. The Wednesday market will begin the first Wednesday following Memorial Day and will end Wednesday preceding the Harvest Festival.

Article III

Management/Organization
Section 1. A Market Board consisting of 7 to 9 voting members will oversee the Market. All officers of the Market serve as Board Members. Vendors or interested residents of Corrales are nominated and elected by the general paid membership of the market to serve as the remaining Board Members.

Section 2.Officers and Board Members of the Market will be elected yearly by the general membership at the annual meeting.

Section3: The Market leadership will be:
Administration Manager
The Market Administrator is responsible for developing and coordinating the markets activities in a manner consistent with the expectations of the market farmers and the community.
Operations Manager
The Operations Manager is responsible for establishing a well-organized safe environment for vendors and customers and to insure that market equipment is maintained, secured and available for ongoing use.
Treasurer
The Treasurer maintains budget records, disperses funds according to the decisions of the market leadership, and provides monthly reports on the financial status of the market.
Secretary
The secretary provides ongoing records of market meeting activities and discussions. The market Secretary is responsible for insuring that minutes are available for review, corrections are made and final copies are dispersed as appropriate.
Board Members
Board Members are responsible for evaluating individuals for membership, may place items on meeting agendas and motion for and cast votes on the acceptance of market programs and policies

Section 4. The Market Leadership will chair individual committees as necessary to facilitate benefits to the operation, promotion and growth of the Corrales Growers’ Markets.

Section 5. Forms will be provided to market members to make written requests to the Board for consideration of specific concerns or suggestions. The Market Board will hear and make timely decisions on any market member complaints, concerns, suggestions or issues as brought to their attention by a member. The Board will make decisions on a case-by-case basis.

Section6. The Market Board has the right to refuse membership to anyone. Members/Growers not in compliance with the Market agreement will be asked to leave and not return until they are in compliance with the agreement.

Section 7: The Market Board will meet the first Sunday of every month.

Article IV

Membership, Space and Fees
Section 1. Membership in the Corrales Growers’ Markets is open to all growers/ farmers in New Mexico who sign up, pay expected fees and abide by the Market bylaws and regulations as determined by the Market Leadership.

Section 2. All growers and farmers signing up for the market will be designated within a vendor category based on but not limited to the following criteria:

A. Corrales Home Gardener
1. Grow at their residence within the Village of Corrales.
2. Participates in the market to sell excess in-season produce from their home garden.
3. Participates in 10 or less markets during the season.

A. New Mexico Home Gardener
1. Grows at their residence within the State of NM.
2. Participates in the market to sell excess in-season produce from their home garden.
3. Participates in 10 or less markets during the season.
4. Participates in other Growers’ Markets.
A. Part-Time Grower
1. Sells agricultural products grown within the State of NM.
1. Derives a portion of their personal income from the sale of agricultural products.
2. Sells both added–value and/or fresh agricultural products.
3. Participates in other Farmers’ Markets.
4. Participates in marketing structures other than Farmers’ Markets.
A. Full-Time Grower/Producer
1. Sells agricultural products grown in the State of NM.
2. Farm as their main source of income.
3. Sells added value and/or fresh agricultural products.
4. Participates in other Farmers’ Markets.
5. Participates in marketing structures other than Farmers’ Markets.

Section 3. At the time of vendor sign-up the Operations Manager will assign a permanent parking space. A parking plan map is created to accommodate maximum vendor participation. Adjustments to the parking plan are made for each market date and event according to expected and actual vendor participation. Vendors will be allowed to park vehicles one (1) hour prior to market opening. Parking spaces will be held for the assigned vendor until 30 minuets prior to the markets opening. After that time, parking will be assigned on arrival. The Operations Manager will make adjustments to the parking map as needed to assure parking strategies result in a well-organized, safe and appealing market place. The market is set up, and opens to customers on specific days during set hours. Vendors are expected to adhere to the established hours of the markets and sell only during those established operating hours. Vendors will be provided with signage designating hours of operation. An audio signal will announce the opening of the market for vendor sales.

Section 4. Vendors arriving after the set market opening time will be assessed a $10.00 late fee.

Section 5. Vendors who want to exit the market prior to designated closing time must get approval from the Operations Manager prior to moving their vehicle

Section 6. The yearly per space fee for parking in the Corrales Growers Market Association will be $35.00 and will be due at the time the vendor registers for the market. Space fees cover participation in both the Sunday and Wednesday regular markets. Special events are separate from the regular markets operation. When deemed appropriate by the Board, additional fees may be assessed.

Article V
Rules Governing Market Participation
Section 1. The Market operates under Ordinance #270 of the Village of Corrales, Sections 8-1-14(B),
Item 7: Grower’s Market - Sale of agricultural products, which are grown and/or prepared by the applicant on their property for human use, or human or animal consumption.
Upon completion and approval of application the Market will request a Growers’ Market
License, issued to the member by the Planning and Zoning Administrator. Upon receipt, the member will display this license while participating in The Market.

Section2: Absolutely NO RESALE of purchased agricultural products or produce is allowed. It is the responsibility of the Farm/Grower/Producer to provide application information and verification of member eligibility

Section 3. New Mexico farm craft items will be accepted only if 75% of their content/ value is derived from agricultural products. No craft products containing a majority of plastic or other artificial craft or purchased products will be allowed.

Section 4. USDA approved scales should be used in sales of products sold by weight. If a USDA scale is not used, the seller is encouraged to sell by the item, bunch, number or volume.

Section5.The Market will purchase and maintain records for a NMDA Blanket Nursery License. Growers must notify the Market by August 15th if they want to be included in this license coverage for the next season. Coverage applies only to products sold at the Corrales Growers’ Market location.

Section 5. The sale of certain products requires certificates or permits issued by the state of New Mexico or other government agencies. Permits include, but are not limited to; processed and cooked foods, fish, dairy products, meats, potted nursery plants, flowers, gathered native vegetation, cactus plants, etc. The Market may request verification of licensing, where appropriate.

Section 6. Vendors are required to declare that they will be selling processed food items at the time of application. Processed food items are accepted by the Market, provided they include 80% of fruits, vegetables, herbs, or flowers grown by the market member or other New Mexico grower sources. These include jellies, jams, canned vegetables and fruits, flavored vinegars, oils, dressings, soaps, breads, dairy products and meats. The Board, on an individual basis, will assess added-value item for sale by market vendors. Items will be evaluated on the basis of their enhancement to the growers regularly sold products, their value as an addition to the variety of products at the market and the items historic/traditional nature. The market will not accept items, which contain a majority of fruits and vegetables not considered by the New Mexico Extension Services to be a crop that can be grown in the New Mexico growing zones. The Market reserves the right to make on site verification of vendor claims. It is the vendor’s responsibility to acquire permits and provide verification of certification to sell processed food products. Necessary certificates must be available at the vendors stand during market hours.

Section 7. For edible items the FDA recommends: your name, common product name, list of ingredients, weight or approximate weight stated as such.

Example:
Mary Smith-Smith Farms Zucchini Bread
Contents-zucchini, flour, butter, sugar.

Section 8. Each Market participant is responsible for their space and will be expected to clean it before leaving the area. The Market area shall be kept free of litter, trash and unsightly clutter. Vendors not in compliance will be assessed a $5.00 fee.
